Retired Judges Urge Appeals Court to Review Opt-In Brokerage Settlements

A group of four retired federal judges has intervened in the ongoing legal battles surrounding real estate commission lawsuits, challenging the validity of the “opt-in” settlements reached in the Tuccori case. The judges, collectively possessing nearly seven decades of judicial experience, filed an amicus brief this week urging the Seventh Circuit Court of Appeals to reverse a lower court’s decision regarding the procedural handling of these agreements.

At the heart of the filing is the concern that approving the current opt-in structure could encourage future defendants to “forum shop” for favorable jurisdictions. The retired jurists—Diane Wood, David Coar, G. Patrick Murphy, and Nancy Gertner—argue that the district court improperly rejected an attempt by plaintiffs in the related Batton lawsuit to intervene. They contend that simply allowing an objection at the final approval hearing is insufficient to address potential structural flaws, such as “reverse-auction dynamics” or the selection of a settlement forum to bypass adverse rulings.

The legal development puts potential pressure on major real estate entities that agreed to the settlements, including Compass, Inc., the National Association of Realtors (NAR), Anywhere, HomeServices of America, and Hanna Holdings. If the appellate court agrees to reverse the lower court’s ruling, the final approval of the settlements could be delayed or disrupted.

In response to the filing, an NAR spokesperson defended the trade group’s position, stating that the settlement process was mediated by a retired judge and approved by the District Court. The NAR emphasized that the agreement offers a broad release for members and brokerages while resolving buyer-side commission claims.

While the final approval hearing is currently scheduled, the intervention by these prominent legal figures adds a layer of uncertainty to the resolution of these widespread industry litigations. Market participants will be watching the Seventh Circuit closely to see if it accepts the brief and alters the trajectory of the case.
